DEVB Technical Circular (Works) No. 6/2021 sets out the policy on the implementation of the Security of Payment (SOP) Provisions in public works contracts with a view to facilitating timely processing of contract payments and providing an interim mechanism for speedy resolution of payment disputes through adjudication before the enactment of the Security of Payment Legislation.

Adjudication provided under the SOP Framework is a speedy resolution of payment disputes.  Appointment of adjudicator by an adjudicator nominating body (ANB) as agreed by the contracting parties is intended to be done shortly after the service of the notice of adjudication.  For the implementation in public works contracts, a simplified mechanism is introduced for the nomination and appointment of adjudicator through an agreed ANB from the Register of Adjudicator Nominating Bodies as specified in the contracts, in order to ensure speedy commencement of the adjudication proceedings.
