Adjudication is meant to provide rapid dispute resolution on an interim basis and the nomination and appointment of adjudicators by an Adjudicator Nominating Body (“ANB”) as agreed by the contracting parties is intended to be carried out shortly after the service of the notice of adjudication. To ensure the timely appointment of adjudicators within the specified time limit, DEVB established and maintained the register of ANBs (“the Register”) that are authorised to perform the functions of an ANB under the Construction Industry Security of Payment Ordinance (Cap. 652).
Eligibility criteria for admission to the Register
Applications for admission to the Register are open throughout the year. An applicant who is a body corporate and established in relation to the local construction industry or dispute resolution for local construction projects with corporate/full members or panelists/listees possessing professional qualifications for architects, engineers, surveyors or lawyers may apply to the DEVB for admission to the Register.
An applicant will be considered eligible to be admitted to the Register if it:-
- demonstrates its suitability in terms of its establishment, capabilities and reputation in taking up the role as an ANB,
- demonstrates its competency in discharging the functions of an ANB,
- demonstrates its flexibility and self-sustainability in operating as an ANB,
- demonstrates its readiness to take up the functions and administrative duties of an ANB, and
- is in all other aspects considered by the Secretary for Development or her delegate as suitable for admission to the Register.
